Purpose of the website

The website www.vip-arena.com presents the VIP Arena concept, a life-size party game published by Curious Factory. It allows the general public to discover the game and locate equipped venues, and leisure professionals to get in touch with the company.

The website is not an online sales platform. No order or booking can be placed on it directly: sessions are booked with the equipped venues, and any business relationship with an operator is governed by the contractual terms signed between Curious Factory and its professional customer.

Access and availability

Access to the website is free of charge, excluding Internet connection costs borne by the user.

Curious Factory endeavours to keep the website accessible 24 hours a day, 7 days a week, but is bound only by a best-efforts obligation in this respect. Access may be interrupted, in particular for maintenance, updates, breakdowns or any cause beyond the publisher's control, without giving rise to any right to compensation.

Curious Factory reserves the right to modify, suspend or discontinue all or part of the website at any time and without notice.

Copyright

The website www.vip-arena.com and each of its components, including but not limited to texts, images, videos, photographs, illustrations, graphics, logos, mascot, icons, sounds, animations, visual identity, databases, structure and source code are, unless otherwise stated, the exclusive property of Curious Factory and may therefore not be reproduced or used without written authorisation.

Any reproduction, representation, modification, publication, adaptation, extraction, reuse or transmission, in whole or in part, of these elements, by any means and on any medium whatsoever, is prohibited without the prior written authorisation of Curious Factory, apart from the exceptions provided for by law, in particular strictly private and non-collective use.

Any unauthorised use constitutes an infringement and may give rise to the civil and criminal liability of its author, in particular under Articles L. 335-2 et seq. and L. 716-4 et seq. of the French Intellectual Property Code.

Trademarks and distinctive signs

VIP ARENA, Very Immersive Party, the VIP Arena logo, the VIP Arena mascot and the other trademarks, logos and distinctive signs appearing on the website are trademarks and creations of Curious Factory. Any reproduction or use of these signs, in particular as a shop sign, domain name, title or trade name, without prior written authorisation, is prohibited.

Software and operation of the game

The VIP Arena software, its interfaces, its technical architecture, its game content and its databases of mini-games and questions are protected by copyright applicable to software, Articles L. 112-2 13° and L. 122-6 of the French Intellectual Property Code, and by database law, Articles L. 341-1 et seq. of the same code.

They are made available to operators only under a named, non-exclusive and non-transferable user licence concluded with Curious Factory and limited to the operating site designated in the contract.

Any use, copying, decompilation, reverse engineering, provision, sub-licensing or commercial exploitation of the software, the console or the game system outside the scope of a valid licence is unlawful and will be prosecuted, in France and abroad.

Likewise, the use of VIP Arena promotional visuals, photographs and videos by an unlicensed third party, in particular to promote a competing or similar activity, constitutes an infringement and, where applicable, an act of unfair competition and free-riding.

Hyperlinks

Outbound links — The website may contain hyperlinks to third-party websites, in particular those of equipped venues. These websites are neither published nor controlled by Curious Factory, which cannot be held liable for their content, their availability, the products or services offered on them, or the use that may be made of the data they collect. Following these links is the sole responsibility of the user.

Links to vip-arena.com — Creating a simple hyperlink to the home page of www.vip-arena.com is free, provided that:

• it does not harm the image, reputation or interests of Curious Factory;
• it does not use framing or in-line linking techniques;
• the source is clearly identifiable.

Any reuse of content, any systematic deep linking or any link suggesting a partnership, affiliation or endorsement by Curious Factory is subject to prior written authorisation, to be requested by email from the publication director. Curious Factory reserves the right to demand the removal of any link that does not comply with these conditions at any time.

In the event of a dispute, and failing an amicable settlement, exclusive jurisdiction is granted to the courts of Cannes / Grasse, notwithstanding multiple defendants or third-party claims, including for urgent or protective proceedings.
